Terms of Service
Welcome to Devomsa. These Terms of Service ("Terms") govern your use of the Devomsa mobile application (the "app") and the Devomsa website at devomsa.com. Devomsa is operated by Shivraj Suryawanshi, an individual proprietor based in Chhatrapati Sambhajinagar, Maharashtra, India ("Devomsa," "we," "us," or "our").
Please read these Terms carefully. By creating an account or using the app, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the app.
1. Who may use Devomsa
The app is intended for users aged 18 years and above. By using it, you confirm that you are at least 18 years old and are able to enter into a binding agreement under applicable law.
2. About Devomsa — what it is, and what it is not
Devomsa is an information directory that helps you discover temples and sacred sites across India and, where a temple has one, directs you to that temple’s own website. It also offers related devotional content and features.
In this app and these Terms, references to a "temple" also include other places of worship and sacred sites of various faiths that may be listed in the app.
Devomsa does not collect, process, hold, route, or facilitate donations, and it does not provide donation links or payment pages for any temple. We are not a payment service, a bank, a trust, or a charitable organisation, and we do not act as an agent of any temple.
Devomsa is purely an information directory. It does not provide, arrange, facilitate, sell, or process any of the following, whether directly or on behalf of any temple or third party: donations or contributions to temples; pooja, seva, chadhava, prasad, or any other ritual, offering, or religious service; astrology, consultation, or prediction services; the booking, purchase, or delivery of any goods or services; or the collection, routing, or handling of any payment intended for a temple. Any such service is a matter solely between you and the temple or third party providing it, obtained by you directly and entirely outside Devomsa.
Devomsa is not affiliated with, endorsed by, or authorised by any temple, trust or government body. Any links to temple websites point to publicly available pages, and all information is provided for reference only.
Because Devomsa never collects, holds, or routes money, we never authorise any person or organisation to collect money on our behalf or on behalf of any temple through Devomsa. Anyone who uses the Devomsa name or logo to request or collect money, or who claims to be affiliated with, endorsed by, or authorised by Devomsa, is acting without our authorisation and may be attempting to deceive you. If you come across any such activity, please report it to us at grievance@devomsa.com.
3. Your account
To use certain features, you must create an account and verify your email address.
You are responsible for keeping your login details secure and for all activity that takes place under your account.
You agree to provide accurate information and to keep it up to date.
You may not share your account, create an account for anyone else, or use another person’s account.
You may delete your account at any time from within the app.
You may not delete, or request deletion of, another person’s account on their behalf, except where you are legally entitled to do so — for example, as the legal representative or nominee of a person who has died or become incapacitated.
If you sign in using Google or Apple, your use of those sign-in services is also subject to Google’s or Apple’s own terms and privacy policies. Please notify us promptly if you believe your account has been accessed without your permission.
4. Donations and links to temple websites
Devomsa is an information directory and does not facilitate donations. Where a temple has a website, Devomsa may show a neutral "Visit Website" link to that temple’s own site, for reference. When you follow such a link, you leave Devomsa and go to the temple’s own website in your browser.
If you choose to make a donation, you do so entirely on the temple’s own website, in your own browser, directly with the temple or its own payment provider. Devomsa is not involved in that transaction, receives nothing from it, and keeps no record of it.
Devomsa does not operate, control, or guarantee the availability, accuracy, or security of any external temple website. You should verify a website’s authenticity before providing any information or making any payment on it. To the fullest extent permitted by law, Devomsa shall not be liable for any loss, fraud, error, or dispute arising from your use of a third-party website or from your dealings with any temple or payment provider.
5. Informational and devotional content
The temple information, deities, sacred circuits, scriptures, historical accounts, and related content presented in Devomsa are provided for general informational and devotional purposes only. Much of this content is drawn from religious texts, oral traditions, and historical accounts that are, by their nature, open to interpretation and may differ between sources. While we make sincere and careful efforts to present this material respectfully and accurately, we do not warrant that it is complete, current, or free from error, and it should not be treated as authoritative religious, historical, legal, or factual guidance. Images are provided for illustration and identification and may not depict a temple, deity, or place exactly as it appears today.
6. Voluntary support of Devomsa
Devomsa may give you the option to make a voluntary contribution to support the running and development of the app. Please note the following:
A voluntary contribution supports Devomsa itself. It is not a donation to any temple, and it is not routed to any temple.
A voluntary contribution is not a charitable or tax-deductible donation. It does not entitle you to any 80G receipt, tax benefit, temple service, or any other benefit.
Support payments are processed by a third-party payment provider (Razorpay). We do not collect or store your payment details.
Voluntary contributions are non-refundable, subject to applicable law and the payment provider’s applicable refund and chargeback rules.
Making, or choosing not to make, a voluntary contribution does not change your access to the app or its temple-discovery features, which remain free.
7. Affiliate links and third-party products
Some devotional content in the app may include links to books, audiobooks, or similar products sold by third parties, such as Amazon. If you make a purchase through one of these links, Devomsa may earn a small commission, at no extra cost to you.
We do not sell these products ourselves. Any purchase is a transaction solely between you and the third-party seller, on that seller’s own terms. We do not control and are not responsible for these products, sellers, or their websites, and the availability of any link may change. Where the app contains affiliate links, we disclose this to you.
8. Content you contribute
The app may allow you to contribute content — for example, temple photographs, corrections, or information submitted through the Contribute or Add Temple features, or feedback. The following terms apply to anything you contribute:
You confirm that the content is yours to submit — that you created it or have the necessary rights and permissions, and that it does not infringe anyone else’s rights.
You confirm that your submission is accurate and genuine to the best of your knowledge, and not false, misleading, or impersonating any person or authority.
You grant Devomsa a non-exclusive, royalty-free, worldwide licence to use, store, review, edit, adapt, publish, display, and distribute your submission within the app and in connection with the app. This licence survives the deletion or removal of your content to the extent reasonably necessary for legal, archival, backup, or dispute-resolution purposes.
You understand that your submission may be reviewed before any use, and that we are under no obligation to use it. We may edit, decline, or remove any submission at any time and for any reason.
You are not entitled to any credit, attribution, payment, or compensation for a submission.
You must not submit anything that is unlawful, infringing, false, misleading, offensive, or that violates the rights or privacy of any person.
You are responsible for the content you contribute. To the fullest extent permitted by law, Devomsa is not liable for content submitted by users, and we may remove any such content at our discretion.
9. Neutrality
Devomsa is a devotional and informational service. It does not express, hold, or endorse any political, social, economic, or ideological position. Where content touches on such matters, it is presented only as part of established tradition or scripture, and never as the opinion or endorsement of Devomsa.
10. Intellectual property
The app, its design, and its original content — including the temple descriptions, curation, text, and features created by Devomsa — are the property of Devomsa and are protected by applicable intellectual property laws.
The name "Devomsa", the Devomsa logo, and our related branding are trademarks or claimed trademarks of Devomsa. You may not use them, or any confusingly similar name or logo, without our prior written permission, including in any way that suggests affiliation with or endorsement by Devomsa.
Certain content is used under the rights of others: temple photographs are used under their respective licenses with attribution to their authors and sources, and scriptural texts are drawn from public-domain sources. These, and content contributed by users under Section 8, remain the property of their respective owners.
You may use the app for your own personal, non-commercial devotional use. You may not copy, reproduce, distribute, scrape, harvest, or commercially exploit any part of the app or its content without our written permission.
11. Prohibited Use
When using Devomsa, you agree not to:
use the app for any unlawful purpose or in violation of these Terms;
attempt to gain unauthorised access to the app, its systems, or other users’ accounts;
access the app through automated means, or scrape, harvest, or copy its data in bulk;
interfere with, disrupt, or attempt to circumvent the security of the app;
reverse engineer or attempt to extract the source code of the app, except as permitted by law;
submit content that is false, misleading, infringing, unlawful, or offensive, or that impersonates any person or authority;
use the Devomsa name, logo, or branding without permission, or represent yourself as affiliated with or authorised by Devomsa;
use the app to harass, harm, defraud, or mislead others.
We may suspend or terminate your access if you breach these rules.
12. Sharing
The app may let you share temples or other content using your device’s own sharing tools and third-party apps you choose, such as WhatsApp. When you do so, your use of those apps is subject to their own terms and privacy policies, which we do not control.
13. Privacy and personal data
The collection, processing, and retention of your personal data, and your rights in relation to it, are governed by our Privacy Policy and by applicable Indian data-protection laws, including the Digital Personal Data Protection Act, 2023 (to the extent and from the date its provisions become applicable to Devomsa). The Privacy Policy forms part of these Terms, and you should read it before using the app.
14. Disclaimer of warranties
The app and its content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by applicable law. Without limiting this, we do not warrant that the app will be uninterrupted, error-free, or secure, or that the information in it is complete, current, or free from error.
15. Reliance on third-party infrastructure
Devomsa relies on established third-party infrastructure and service providers, including Google Firebase, Cloudinary, and Razorpay, to operate the app, store data, and process support payments. We select reputable providers and take reasonable care, but we do not control their systems. To the fullest extent permitted by law, Devomsa shall not be liable for any interruption, failure, loss, or unauthorised access to data that originates within these providers’ systems and is beyond our reasonable control.
16. Limitation of liability
To the fullest extent permitted by law:
Devomsa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the app.
Devomsa shall not be liable for any loss, fraud, error, or dispute arising from your use of a third-party temple website, an affiliate link or third-party product, or a support payment, or from your dealings with any temple, seller, or payment provider.
Devomsa shall not be liable for content contributed by users, or for interruptions, failures, or unauthorised access originating within the systems of our third-party providers and beyond our reasonable control.
Nothing in these Terms excludes or limits our liability where it cannot be excluded or limited under applicable law.
17. Events beyond our control
Devomsa is not liable for any failure or delay in providing the app that results from events beyond our reasonable control, including natural disasters, epidemics, failures of internet or telecommunications infrastructure, power failures, or the actions of government authorities or third-party providers.
18. Indemnity
You agree to indemnify and hold harmless Devomsa from and against any third-party claims, liabilities, losses, damages, and reasonable legal expenses arising from your misuse of the app, your breach of these Terms, or any unlawful or infringing content you submit.
19. Changes to the app and to these Terms
We may add, change, or discontinue features of the app at any time. We may also update these Terms from time to time; when we do, we will update the "Effective Date" above and post the revised Terms at the same web address. Your continued use of the app after the changes take effect means you accept the revised Terms.
20. Suspension and termination
We may suspend or terminate your access to the app if you breach these Terms or use the app in a way that may cause harm or legal risk. You may stop using the app and delete your account at any time.
21. Grievance Officer and contact
For any questions, concerns, or grievances regarding the app or these Terms, you may contact:
Shivraj Suryawanshi
Grievance Officer, Devomsa
Email: grievance@devomsa.com
Chhatrapati Sambhajinagar, Maharashtra, India
We will acknowledge and address grievances within a reasonable time and in accordance with applicable law.
22. Governing law and jurisdiction
These Terms are governed by the laws of India. Any disputes arising from or relating to these Terms or the app are subject to the jurisdiction of the courts having competent jurisdiction at Chhatrapati Sambhajinagar (Aurangabad), Maharashtra.
23. General
The sections relating to intellectual property, contributed content, disclaimers, limitation of liability, and indemnity survive the termination of your account or these Terms.
We may transfer our rights and obligations under these Terms to another party, for example if the operation of Devomsa is transferred to a new entity. You may not transfer your rights under these Terms to anyone else.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full effect.
Our failure to enforce any provision is not a waiver of our right to enforce it later.
These Terms, together with our Privacy Policy, form the entire agreement between you and Devomsa regarding your use of the app.
